TERMS AND CONDITIONS OF SALE

PURPOSE
The purpose of these general terms and conditions of sale is to define the rights and obligations of L’Atelier Rosie and the Customer of products presented by L’Atelier Rosie on its website www.latelierrosie.fr (hereinafter “the Site”). They apply exclusively between the company L’Atelier Rosie, 2 Chemin de Seguin, ZA Port-Neuf 33360 Camblanes, Siret: 891 958 779 00011 (hereinafter “L’Atelier Rosie”) and any individual consumer visiting or making a purchase via the said Site (hereinafter “the Customer”).

On the Site, L’Atelier Rosie allows the Customer to order L’Atelier Rosie brand products online (hereinafter “the Product(s)”) in accordance with these terms and conditions.
Any order placed with L’Atelier Rosie therefore implies the Customer’s unreserved acceptance of these terms and conditions. These terms and conditions may be modified at any time and without prior notice by L’Atelier Rosie, the applicable terms and conditions being those in force on the date of the Customer’s order.

The present general terms and conditions of sale are permanently accessible at the following address: https://www.latelierrosie.fr/fr/content/3-conditions-generales-de-ventes in a computer format that allows them to be printed and/or downloaded, so that the customer can reproduce or save them.

PRODUCTS AND COMPLIANCE
2.1 The Products offered for sale are presented on the L’Atelier Rosie website and are accompanied by a description.

2.2 The Products offered by L’Atelier Rosie comply with the standards applicable in France.
Elements such as photographs, texts, graphics as well as all information and characteristics illustrating and/or accompanying the Products are not contractual, which the Customer acknowledges.

Consequently, L’Atelier Rosie cannot be held responsible in the event of error or omission of any of these elements or in the event of modification of said elements by suppliers and/or publishers.

OBLIGATIONS OF THE CUSTOMER
3.1 The Customer declares that he/she is at least 18 years of age and has the legal capacity or parental authorization to place an order on the Site.

3.2 The Customer undertakes to provide L’Atelier Rosie with the actual information required to perform the service covered by these terms and conditions as requested online and according to his/her situation, in particular his/her surname, first name, address, telephone number and valid e-mail address.

The customer is liable for any consequences arising from the transmission of false or inaccurate information, or the unlawful use of such information.

3.3 Once the order has been placed, L’Atelier Rosie will send the Customer an e-mail confirming the order. It informs the Customer of the shipment of the Products.

3.4 The Customer can modify his data in the “My Account” section.

ORDER
4.1 All orders will only be validated once payment has been accepted.

4.2 Atelier Rosie reserves the right to cancel or refuse an order in the event of a dispute with the Customer over a previous order.

4.3 Atelier Rosie may accept orders subject to availability. It informs the Customer of the availability of the Products sold on the Site at the time of order confirmation.

If, despite the vigilance of L’Atelier Rosie, the products are unavailable, L’Atelier Rosie will inform the Customer by e-mail as soon as possible. The Customer may then cancel the order and be reimbursed for any sums already paid.

L’Atelier Rosie shall not be held liable for any permanent or temporary unavailability, nor shall such unavailability entitle the Customer to any compensation or damages whatsoever.

PRICES
The prices displayed on the Site are in euros and include all French taxes (French VAT and any other applicable taxes), but exclude postage, order processing and packaging costs.

Shipping costs, order processing costs and packaging costs will be indicated in the Customer’s basket before the order is finally validated.

Prices may be modified at any time, without prior notice, particularly in the event of changes in tax or economic data. Items will be invoiced on the basis of the prices in force at the time the order is registered.

DELIVERY
Atelier Rosie delivers its Products in France.
Products are shipped to the delivery address indicated by the Customer at the time of ordering. Delivery cannot be made to hotels or post office boxes. The delivery times indicated on the site are indicative times, corresponding to average processing and delivery times. In order for these times to be respected, the Customer must ensure that he has provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).

In the event of a delay in delivery of more than 15 working days, if the product has not been dispatched, the Customer may cancel the order by registered letter with acknowledgement of receipt and request a refund of the order.If the item has been shipped prior to receipt of the cancellation of the order for late delivery of more than 15 days, L’Atelier Rosie will not proceed with any refund and the product will be delivered in due form.

L’Atelier Rosie undertakes to inform the Customer of the progress of his/her order.
In the event of damaged packages (already opened, missing products, etc.), the Customer undertakes to notify the carrier and L’Atelier Rosie, by any means, of any reservations within 3 days of receipt of the product.

Atelier Rosie cannot be held responsible for the consequences of a delay in delivery that is not its fault.

PAYMENT
Payment must be made in full at the time of ordering. At no time may the sums paid be considered as deposits or advance payments. The customer pays for his order by credit card (Visa, Eurocard/Mastercard), in accordance with the provisions of the present article.

Atelier Rosie accepts payment by cheque or cash. The customer must contact our workshop in order to offer this method of payment.
For all transactions, the customer must indicate the number on the front of the card, the expiry date of the card and the cryptogram on the back of the card (last three digits).

The communication by the Customer of his/her credit card number constitutes authorization for L’Atelier Rosie to debit his/her account for the amount of the order.

Cash on delivery will not be accepted for any reason whatsoever.

Atelier Rosie retains ownership of the item until full payment of the price by the Customer.

Purchases are made securely. The payment solutions adopted by L’Atelier Rosie are 100% secure. For credit card payments (Carte Bleue, Carte Bleue Visa and e-Carte Bleue), all information provided by customers to L’Atelier Rosie is strictly protected and guarantees the conformity and security of each transaction.

PRODUCT RETURNS AND REFUNDS
RIGHT OF WITHDRAWAL

Within thirty (30) days of receipt of the order, the Customer may request L’Atelier Rosie to return the Product(s) in exchange for a credit note. Only gift packaging may not be returned, nor may a credit note be issued.
Returns are at the Customer’s expense. Returns are made at the Customer’s risk. The Product must be returned in its original packaging, in its original condition, new and unused.

If the Customer fails to comply with these conditions, in particular the return conditions, L’Atelier Rosie will not be able to issue a credit note for the products concerned.

GUARANTEES AND LIABILITY
L’Atelier Rosie has only an obligation of means for all stages of access to the site, from the ordering process to dispatch of the parcel or subsequent services. L’Atelier Rosie may not be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses, or for any event qualified as force majeure, in accordance with the law and jurisprudence.

INTELLECTUAL PROPERTY
Under no circumstances may the Customer download or modify all or part of the Site, and in particular its content (products listed, descriptions, images, videos, etc.).

This Site or any part of this Site may not be reproduced, copied, sold or exploited for any commercial purpose without the express written permission of L’Atelier Rosie.
In general, all copyrights, trademarks and other distinctive signs and property rights or intellectual property rights appearing on the Site shall remain the full and complete property of L’Atelier Rosie.

The Customer is therefore bound to respect intellectual property rights and may not use the trademarks appearing on the Site or on the Products, as the case may be, or register a trademark that would be prejudicial to the owner of the rights, unless otherwise stipulated in the contract.

The same applies to all other intellectual property rights.

11. WARRANTIES AND LIABILITY

Atelier Rosie undertakes to use confidential Customer information only in the context of operating its Site.

For the proper processing of the order, the personal data collected will be subject to computer processing, and the Customer acknowledges having knowledge thereof.
In this respect, information concerning the Customer may be communicated to technical service providers of L’Atelier Rosie.

In addition, L’Atelier Rosie may apply technical means to obtain non-personal information relating to Internet users and intended to improve the functionality of the site, for example by tracking the number of visitors to certain pages.

In accordance with the French law of January 6, 1978, modified by the law of August 6, 2004, the Customer has the right to access and rectify any personal data held on file by L’Atelier Rosie. This data processing has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL), which issued receipt no. 1517135 v 0 on June 29, 2011.

GENERAL PROVISIONS
12.1. PARTIAL NON-VALIDITY OF A CLAUSE
If any provision of these terms and conditions is declared invalid or unenforceable by a court of competent jurisdiction, it shall be declared unwritten and shall not invalidate the other provisions.

12.2. UPDATE

These terms and conditions may be modified at any time and without notice by L’Atelier Rosie, the applicable conditions being those in force at the date of the order by the Customer.

12.3. APPLICABLE LAW – COMPETENT COURT

These terms and conditions are governed by French law with regard to both form and substance. Any dispute shall be subject to a prior attempt at amicable settlement.

In the absence of an amicable settlement, jurisdiction is assigned to the competent French courts, notwithstanding multiple defendants or the introduction of third parties.
